The right to marry as a fundamental right

Another issue addressed as part of the project Marriage in the light of the doctrine of imperative requirements is the right to marry from the perspective of existing systems for the protection of fundamental rights. Theoretical considerations on this topic are discussed in more detail in expert opinions prepared by representatives of academia, which are presented on the project website. The aim of the seminar was to present practical issues related to the implementation of the right to marry from the perspective of the case law of the European Court of Human Rights and the Court of Justice of the European Union. Solutions and instruments for the protection of the analyzed right at the UN level were identified. The last presentation was devoted to a very interesting issue, which is currently widely discussed both in the literature on the subject and in the media – the problem of cross-border marriages from the perspective of civil status records.
