In the presented expert opinion, the Professor undertakes to present the definition of marriage and parenthood in the Austrian legal system. As the Professor writes, the legislation of the Republic of Austria defines the institution of marriage and parenthood in the Constitution of the Republic of Austria, the constitutions of each of the nine Länder (each of them defines the institution of marriage and parenthood in its own way) and the Austrian Civil Code. The doctrine and case law take the view that the interpretation of national and federal constitutional provisions should be made in accordance with the provisions of Art. 12 of the European Convention on Human Rights and Fundamental Freedoms and Art. 9 of the Charter of Fundamental Rights of the European Union. Austrian legislation also guarantees the equality of spouses and the voluntary nature of their relationship, the protection of marriage and family, and the rights of parents and children.
